Credai: Concerned At The Increase In Repo Rate

Hyderabad, October 29th, 2013: The Confederation of Real Estate Developers’ Associations of India (CREDAI) the apex body for private real estate developers in India expressed their concern over the RBI decision to increase the repo rates by 25 bps in the second-quarter monetary policy review. The step is only aimed at its inflation-fighting credentials despite the country’s sputtering economic growth and weak investment demand.

Speaking on the development Mr. C Shekar Reddy President CREDAI- National said,” Considering the overall economic situation and challenges being faced by the industry, we were looking forward to the reduction in repo rates, to ease the burden on the buyers and developers. The continuation of the policy to increase in repo rates in the monetary policy, to control the inflation, will be further increasing the problems of the developers who are grappling with high interest rates. We were hopeful that besides easing the liquidity, RBI will start addressing the industry concerns for growth and give the necessary impetus.”

He further added “Housing has long been identified as a social priority next only to food and clothing. According to Housing and Urban Poverty Alleviation (HUPA) estimates present housing shortage is 18.7 million units with almost 96% shortage in the shelter for Economically Weaker Section (EWS) & Lower Income Group (LIG). There is an expected total housing requirement of 60 million units by 2030 in India. Keeping in view the demand supply gap in the affordable housing segment, Government needs to support the sector by focusing on development initiatives like recognizing affordable housing as a priority sector for funding and providing added incentive to the lenders, developers and the economy at large. RBI should consider increasing the exposure to Commercial Real Estate (CRE) segment from 3% to at least 12% and encourage the funding of SME projects in tier I, tier II and tier III towns and cities to boost the segment. Such initiatives will facilitate the flow of formal credit to the sector and encourage the developers to take up more projects in the affordable housing segment. We are keen on meeting the RBI Governor to table and discuss the concerns of the Real Estate sector.”

New Bill Proposes Licences For Real Estate Brokers : Premia Corporate City Noida

NOIDA: The UP government has planned to draft a new law to tighten the noose around fraudulent real estate agents so that interests of homebuyers are protected. A senior official in Lucknow said that under the law dealers are required to register themselves with a local government body and obtain a license for practicing.

The UP urban housing department is drafting the bill to regulate property brokers. “Once the draft bill is ready, it will be approved first by the cabinet and then passed by the legislative assembly to make it a law,” said an official.

With the boom in real estate, especially in areas like Noida, Greater Noida and Yamuna Expressway, a large number of cases of property fraud and cheating have cropped up. “Usually police do not entertain such cases or have no means to bring the fraudsters to book. The bill will ensure that interests of the common man are protected stringent action is taken against unethical dealers,” the official said, adding that while brokers enjoy handsome commissions, with a few big players making crores of Rupees overnight, they hardly take any responsibility of buyers in cheating cases.

The draft states, “The district magistrate or any other top official in each district will be appointed as the nodal officer, who will issue licences and address grievance of buyers against erring agents, who, in the absence of any regulatory authority go scot-free in case of cheating or poor services.”

Realty experts said this decision will bring in more accountability, reliability and transparency for homebuyers. “This decision should have been taken much earlier. Strict implementation of the bill is required in order to make this effort a success,” said RK Arora, vice president CREDAI (west UP) and CMD Supertech group.

Other developers said brokers play a major role in the real estate sector. “Due to a few unethical brokers, the entire industry suffers. We hope this bill will boost the credibility of the realty sector,” said Amit Gupta, MD, Orris Infrastructure and member Assocham.

India May Take Us To World Trade Organisation Over Intellectual Property Rights Row

India is likely to take the US to World Trade Organization if it is included in the ‘Priority Foreign Country’ list for IP rights; this could further escalate trade tensions between the two nations.

New Delhi: India is likely to drag the US to World Trade Organization (WTO) if America includes it in the ‘Priority Foreign Country’ list for intellectual property rights, a development that could further escalate trade tensions between the two.

The US industry and trade lobbies are putting pressure on their government to put India under this list, sources said.

Officials in Delhi said the demand is “completely wrong” as India’s intellectual property rights are complaint with global laws, including the WTO.

Under the US Trade Act, a Priority Foreign Country is the worst classification given to those which deny adequate and effective protection of intellectual property rights (IPR) or fair and equitable market access to the US persons relying on IPR protection.

Inclusion into this list leads to trade sanctions. “If the US does that, then India probably will have no option but drag them to the WTO’s dispute settlement mechanism,” an official said.

The US International Trade Commission (USITC), a quasi-judicial federal American agency, has already initiated an investigation against India’s trade and investment policies.

It has alleged that New Delhi’s laws discriminate against the US companies. “The country’s IPR (intellectual property rights) laws are fully compliant with WTO. If America has any issue with our laws, they can raise that in the WTO,” the official said.

To follow up the probe, USITC officials have sought a meeting with Indian officials. However, the government has rejected the request. India and the US are fighting several cases in WTO’s dispute panel. Recently the US has dragged India on the country’s national solar programmed.

The Obama administration had been strongly criticizing India’s investment climate and IPR laws, especially in the pharmaceuticals and solar sectors.

The USITC wanted to meet Planning Commission Deputy Chairman Montek Singh Ahluwalia, 15 secretaries and 6-7 joint secretary level officers from ministries including DIPP, Animal Husbandry, Health, Telecommunication, Commerce and Health.

American pharma companies had objected India’s move to issue a compulsory license (CL) in March, 2012 to Hyderabad-based Natco Pharma to manufacture and sell cancer-treatment drug ‘Nexavar’ at a price over 30 times lower than charged by patent-holder Bayer Corporation.

The USITC has raised this issue besides the rejection of patent to Bristol-Myers Squibb’s Sprycel and Novartis’ Gleevec. It has stated that Indian IPR laws are not Trade Related Aspects of Intellectual Property Rights (TRIPS) compliant under the WTO.

Swiss pharma major Novartis AG had lost a legal battle for getting its blood cancer drug Gleevec patented in India and to restrain Indian companies from manufacturing generic drugs. The Supreme Court had rejected the multinational company’s plea last year.
